Update on the Labour Law Amendment process

The Department wishes to update the workers and intended beneficiaries on the promulgation of the Unemployment Insurance Act (Act 10 of 2016) and the finalization of the amendment process of the Compensation of Occupational Injuries and Deceases Act and the Occupational Health and Safety Act.

Workers and the intended beneficiaries take note that all the processes required before tabling Amendment Bills in Parliament have been finalized. The Department assures you that it is working around the clock to ensure that the two Amendment Bills are tabled in Parliament before the end of the financial year.

Furthermore the Department gives assurance to the Unemployment Insurance Fund (UIF) beneficiaries that it is working towards the promulgation of the Unemployment Insurance Amendment Act assented to by the President in January 2017. The regulations, which are necessary for proper implementation of the amended Unemployment Insurance Act, have been finalized and ready for publication.

The Unemployment Insurance Fund has completed the configuration of its IT systems and is at an advanced stage of the testing process. Currently the Fund is working on a process to ensure that the amended provisions are free of errors and are aligned with the Fund’s business processes before promulgation to avoid unintended consequences.

The delay is regrettable; however, the aforementioned process is necessary and important to ensure that the Department and the intended beneficiaries are not unnecessarily disadvantaged.

Therefore, the Department extends its word of gratitude to all the workers and the intended beneficiaries of the abovementioned legislation for their patience and understanding.
