PRETORIA, South African Police Minister Fikile Mbalula says her department had followed the letter and spirit of the law in removing Berning Ntlemeza as head of the police Priority Crimes Directorate, commonly known as the Hawks.

Ntlemeza was removed from his position last week after a court found that his appointment was irrational in the light of dishonest actions. Ntlemeza had reported for work Monday despite the High Court order which set aside his appointment.

His lawyer Comfort Ngidi says they will approach the High Court to compel the minister to allow his client to return to work pending the appeal process.

Mbalula has told a media briefing that his department had followed the letter and spirit of the law in replacing Ntlemeza and that his attempts to resume work will be dealt with decisively.

Mbalula replaced Ntlemeza with Yolisa Matakata in an acting capacity.

The High Court in Pretoria had earlier found that the appointment of Ntlemeza was irrational as he had been found to be dishonest among other things.

Mbalula said his department is not fighting with anyone, including Ntlemeza, but is simply complying with court orders. He said Ntlemeza’s presence at the Hawks offices in Pretoria is unlawful as the court order of April 17 against Ntlemeza still stands and is being executed.

He also said Ntlemeza is unlawfully in possession of a State vehicle and cell phone and he has instructed Police Commissioner Khomotso Phahlane to ensure that State property in Ntlemeza’s possession is recovered before end of business on Monday.

Ntlemeza has returned the State vehicle in his possession, but still kept the cellphone.
